Planning Application No. 12/P/0135/F - Reinstatement of dwelling at Whitley Head House, Plot 1363 Whitley Head, Banwell (Agenda Item 6.1)

 

The Director of Development and Environment’s representative reported on the above application and referred to the update sheet, a copy of which is filed on the signed minute book.

 

Resolved:  that the application be refused for the following reasons:

 

1.      The proposed dwelling would be located outside the Banwell settlement boundary, in a location that has limited access to services or public transport and where the occupants would be reliant upon the private motor vehicle, and as such would increase the need to travel and increase out commuting in this unsustainable location and as such the proposal is contrary to Paragraphs 30 and 55 of the National Planning Policy Framework, Policies CS14 and CS33 of the Core Strategy  and Policy H/8 of the North Somerset Replacement Local Plan.

 

2.      The building is an agricultural building and its residential use has long since been abandoned, and as such it does not fall within the criteria set out in Policy H/8 for residential development in the countryside as the buildings last previous lawful use was non-residential.  As such it falls within the criteria set out in Policy RD/3 which relates to the conversion and re-use of rural buildings, and is required to firstly be marketed for other uses other than residential. Insufficient information has been submitted with this application to demonstrate that every reasonable attempt has been made to secure a suitable business or tourism use for the building. As such the proposal is contrary to Policies H/8  and RD/2 of the North Somerset Replacement Local Plan.

 

3.      The proposed dwelling by reason of the creation of a large area of domestic curtilage, together with the increase in activity would erode the open character of the countryside and would adversely impact upon the landscape of the Mendip Hills AONB and as such would be contrary to the National Planning Policy Framework, particularly Policy CS5 (paragraph 109) of the Core Strategy and Policies GDP/3 and ECH/8 of the North Somerset Replacement Local Plan.

Planning Application No. 12/P/0418/F - Retrospective application for erection of extension to existing building to form reception and golf shop and the formation of car park area and access track at Bleadon Hill Golf Course, land off Roman Road, Bleadon Hill, Weston-super-Mare (Agenda Item 6.2)

 

The Director of Development and Environment’s representative reported on the above application and referred to the update sheet, a copy of which is filed on the signed minute book.

 

Resolved:  that the application be approved subject to the following conditions:

 

1.      The lean to extension to the building, car parking area, section of access track and warning signs hereby permitted shall be removed and the land restored to its former condition on or before 30 April 2015 in accordance with a scheme of work to be submitted to and approved in writing by the Local Planning Authority.

2.      Within 2 months of the date of this permission warning signs, as described on submitted drawing No. 1640-04 and in positions shown on drawing No. 1640-05 advising drivers that pedestrians have priority and vehicle speed should be reduced, shall be erected on the access track where it is used as a public footpath and a grass strip 1 metre wide adjacent this section of the access track shall be provided for pedestrians and this shall be regularly mown and grass kept short.

3.      The premises hereby permitted shall be used for the purpose of a golf shop only selling equipment, products and clothing specifically designed for and used for golf and for no other purpose (including any other purpose in Class (A1) of the Schedule to the Town and Country Planning (Use Classes) Order 1987 or in any provision equivalent to that Class in any statutory instrument amending, revoking and/or re-enacting that Order.  The retail use shall cease immediately should the golf course cease to operate.

4.      The surface of the access track shall be maintained in a good state of repair and reasonable steps shall be taken to prevent dust occurring from its use in accordance with a scheme to be first submitted to and approved by the Local Planning Authority.

5.      The development hereby permitted shall be carried out in accordance with the following approved plans: Drwg. Nos. 01-Existing Survey; 02-Block plan extract-access track adjacent Roman Road; Site location plan. Supporting Statement and Drawing nos. 1640-04 and 1640-05
