Declarations of Interest by Members

 

Members declared disclosable pecuniary interests in respect of the following matters:

 

Councillor Jill Iles - Agenda Item 6.2 as a landowner whose property might be affected by the proposals (Minute No. PAR 11 refers).

 

During the debate on Agenda Item 6.2 Councillor David Shopland indicated that as a landowner within the district he could be similarly affected, depending on the route chosen (Minute No. PAR 11 refers).

The Localism Act 2011 and Code of Conduct (COU 40)

 

The Committee received a reference from the recent Council Meeting regarding proposals for the establishment of a sub-committee to consider allegations relating to code of conduct breaches.

 

Responding to Membersí questions about the provisions of the Councilís newly adopted Code of Conduct the representative of the Deputy Head of Legal and Democratic Services undertook to prepare a report for consideration at the next meeting regarding whether the sub committee would be subject to political balance and also to answer any additional questions and queries Members wished to submit.

Designated Public Place Orders (Agenda Item 6.1)

The Director of Development & Environment reported on proposals for designated place orders in Congresbury.

 

Welcoming the proposals it was,

 

Recommended to the Council: that the necessary consultations and advertisements be undertaken in accordance with the Local Authorities (Alcohol Consumption in Designated Public Places) Regulations 2001 to establish whether or not it is appropriate to make designation orders under sections 12-16 of the Criminal Justice Act 2001 (as amended) in respect of:

 

1. King George V Playing Fields, Congresbury;

2. Millennium Green, Congresbury.

National Grid - Western Power Distribution link between Churchill and Weston-super-Mare (Agenda Item 6.2)

 

Having declared a potential disclosable pecuniary interest in this matter Councillor Jill Iles left the meeting prior to any discussion.

The Director of Development & Environment reported on proposals for a new sub-station in the Churchill/Sandford area, together with proposals for connecting the sub-station to the existing supply line for Weston-super-Mare.

 

During the debate Councillor David Shopland declared a potential disclosable pecuniary interest in this matter and left the meeting.

 

Resolved: that National Grid be advised as follows:

 

1.††† That the proposed sub-station site west of Nye Road, Sandford is the preferred site and that any landscape and biodiversity impacts are mitigated by designing the whole sub-station as a Gas Insulated station with extensive landscaping and bat roosting features and swallow ledges;

 

2.††† That the National Gridís preferred option of Route B for overhead works with wooden poles is acceptable.Undergrounding would have significant extra landscape benefits but there would be severe considerations for archaeological and biodiversity interests which would have to be addressed if this option is chosen;

 

3.††† That it is critical that the character of the Mendip Hills Area of Outstanding Natural Beauty, the Tickenham Ridge and the views across the levels from the settlements of Nailsea, Tickenham and Yatton are protected.In addition, any adverse impacts on archaeological/biodiversity interests need to be taken into account when considering any undergrounding works.

 

Councillors Iles and Shopland then rejoined the meeting.

Delegation Arrangements for Planning Applications (Agenda Item 6.3)

The Director of Development & Environment reported on proposals for updating the arrangements for the referral of planning applications and enforcement cases to the Area Committees.

 

Discussing the proposals Members pointed out areas where minor amendments to the text were required.

 

Resolved: that subject to the amendments identified the proposed changes to the Protocol and Code of Practice be agreed with effect from 1 August 2012.

Local Enforcement Plan (Agenda Item 6.4)

The Director of Development & Environment reported on proposed changes to the Councilís enforcement policy.

 

Resolved: that the Local Enforcement Plan and Advertising Protocol be adopted with immediate effect.
