Advising that he had known the business founder Councillor David Shopland stated that he had reason to believe that a family member was concerned with the current venture and as a consequence he would leave the meeting when the matter was discussed (Minute No. PAR 37 refers).

            Resolved: that the minutes of the meeting be approved as a correct record.

7         

Planning Application No. 16/P/0150/O Outline application for residential development of up to 150 dwellings, public open space, allotments, football pitches, etc.  All matters reserved for subsequent approval at land north of Oldmixon Road, Hutton, Weston-super-Mare (Agenda item 6)

 

            The Director of Development & Environment reported on an appeal against non-determination.

 

            The representative of the Director of Development & Environment drew Members’ attention to the update sheet a copy of which is filed on the Minute Book and in particular to additional comments from the Internal Drainage Board and from third parties.  Members noted that the reasons for refusal had been amended.

 

            Members considered that the application site fell within land which had an important role in separating Weston-super-Mare, Weston Villages and Hutton and requested that officers review the extent of the ‘gap’ as defined in the Consultation Draft Sites Allocations Plan with a view to incorporating the site in the Publication Version of the Plan.

 

            Resolved:

 

            1)      that had the Committee been in a position to determine the application the Committee would have been minded to refuse permission for the following reasons:

The proposal is for residential development on land outside the settlement boundaries for Weston-super-Mare and Hutton as defined in policy H/7 of the North Somerset Replacement Local Plan and is contrary to policies CS28 and CS33 of the North Somerset Core Strategy as proposed to be modified and is therefore contrary to paragraph 14 of the NPPF.

The development will harm the rural landscape character and quality of the area and will also cause the sprawl of the urban area into open land that functions to separate Weston-super-Mare from Hutton and Weston Villages. This will detract from the rural setting of the Mendip Hills Area of Outstanding Natural Beauty, contrary to policies CS5, CS12, CS14, CS19 and CS33 of the North Somerset Core Strategy, policies DM10,  DM11 and DM 32 of the draft Sites and Policies Plan Part 1 Development Management Policies and the objectives of the NPPF paragraphs 64 and 66

In the absence of a S106 agreement that will mitigate the impacts of the proposed development  the proposals are contrary to policies CS9, CS10, CS16, CS20, CS25, CS26, CS27 and CS34 of the Core Strategy, policies DM70 and 71 of the draft Development Management Sites and Policies Plan Part 1 and the Council’s adopted Development Contributions SPD.

 

 2)        that accordingly the appeal be defended on this basis.

8         

Planning Application No. 16/P/0859/F Erection of hotel following demolition of existing public house at the Bungalow Inn, Kingdown Road, Butcombe  (Agenda item 7)

 

            Having previously declared an interest in this application Councillor Shopland left the meeting prior to any discussion on the matter.

           

            The Director of Development & Environment reported on an application for planning permission.

 

Members considered that the proposal would cause harm to the openness of the green belt and would be detrimental to highway safety.

 

            Resolved: that the application be refused for the following reasons:

The proposed replacement building, by reason of its massing, form, height and floor area, is significantly larger than the building as it existed in 1985.  This is inappropriate development which would harm the openness of the Green Belt and very special circumstances are not considered to exist which would outweigh this harm.  The proposal is therefore contrary to Policy DM12 of the adopted North Somerset Sites and Policies Plan Part 1 and paragraphs 87, 88, and 89 of the National Planning Policy Framework.

The proposed development would result in a significant increase in traffic in the area which, due to the restricted nature of the road network and access to the A38, would be detrimental to highway safety.  As such the proposal would be contrary to policy DM24 of the adopted North Somerset Sites and Policies Plan Part 1.

 

            Councillor Shopland then re-joined the meeting.

9         

Planning Application No. 16/P/1412/RG3 Erection of 24 Beach Huts and associated infrastructure at southern end of promenade west of Marine Parade, Weston-super-Mare (Agenda item 8)

 

            The Director of Development & Environment reported on an application for planning permission.

 

            Resolved: that the application be approved subject to the following conditions:

           

1.      

The development hereby permitted shall be carried out in accordance with the approved plans and documents to be listed on the decision notice.

2.

The beach huts hereby approved shall be permanently securely affixed to the ground in order to prevent them being moved during flooding or adverse weather.

3.

The beach huts hereby approved shall be painted only in accordance with the colour details submitted with the application, unless otherwise agreed in writing with the Local Planning Authority.

4,

The beach huts hereby permitted shall be used for recreational purposes only and shall not be used for overnight accommodation.

Planning Application No. 16/P/1325/F Erection of 2 no. single-storey dwellings and associated works comprising of the widening of the existing access from Ash Hayes Drive, hardsurfaced driveway and turning area and the erection of two car ports at 8 Mayfair Avenue, Nailsea (Agenda item 9)

 

            The Director of Development & Environment reported on an application for planning permission.

 

Members considered that the proposal was unsuitable in this location due to the cramped nature of the development the form of which would be out of character with other properties in Mayfair Avenue.

 

            Resolved: that the application be refused for the following reasons:

The two proposed single storey dwellings, because of their size, siting and design would result in a cramped form of development with small and restricted garden areas and insufficient garden area for no. 8 Mayfair Avenue and as such the development would be out of keeping with the character particularly of Mayfair Avenue and the surrounding area, contrary to Policy CS12 of the North Somerset Core Strategy, Policy H7 of the North Somerset Replacement Local Plan and Policies DM32 and DM37 of the North Somerset Sites and Policies Plan (part 1).

2.

Notwithstanding the provision of 2 off street car parking spaces for No 8 Mayfair Avenue, the proposed development would result in additional on street parking along Mayfair Avenue and would result in the loss of on street parking in Ash Hayes Drive to the detriment of highway safety and is therefore contrary to Policy CS11 of the North Somerset Core Strategy and Policy DM24 and DM28 of the North Somerset Sites and Policies Plan (Part 1).

Planning Application No. 16/P/0887/F Erection of second floor extension to south (front) elevation at 20A Providence Lane, Long Ashton  (Agenda item 10)

 

            The Director of Development & Environment reported on an application for planning permission.

 

            The representative of the Director of Development & Environment drew Members’ attention to the update sheet a copy of which is filed on the Minute Book, reporting a correction description.

 

            Resolved: that consideration of the application be deferred pending a site inspection.
